This legal notice applies to the use of Bloementheater's webshop and to all agreements concluded through the webshop.

By visiting the website or placing an order, the user declares to have taken note of this legal notice and to accept it.

Product information

Bloementheater strives to describe and display all products as accurately as possible.

Because flowers and natural materials vary by season and availability, colors, shapes, and compositions may differ slightly from the photos and product representations on the webshop.

Bloementheater reserves the right to adjust or replace products with equivalent alternatives if certain flowers or materials are temporarily unavailable.

Prices

All prices on the webshop are expressed in euros and include VAT, unless stated otherwise.

Any delivery costs will be clearly stated before the customer definitively confirms the order.

Bloementheater reserves the right to adjust prices at any time. The price applicable at the time of ordering will apply to the concluded agreement.

Orders and payment

An order is final after the customer has received a confirmation by email.

Bloementheater reserves the right to refuse an order in case of:

-incomplete or incorrect data;

-suspicion of fraud or misuse;

-payment problems;

-force majeure or unavailability of products.

Payment is made via the payment methods offered on the webshop.

Pre-order items

Pre-order items are currently not in stock but can be ordered in advance. We make these items specifically to order, which means the delivery time may differ from our usual delivery period. Therefore, we advise ordering pre-order items in good time.

As these items are custom-made for you, they cannot be returned or exchanged.

Shipping and Delivery Policy

Order processing

We strive to process every order with the utmost care. Orders are typically processed within 1 to 3 business days of receiving payment. The specified delivery times are indicative and may vary depending on busyness, availability, weather conditions or external transport services. During busy periods, holidays or promotional campaigns, processing times may vary slightly. In that case, we always do our best to ship your order as quickly as possible.

Shipping costs

Shipping costs are automatically calculated during checkout and clearly displayed before completing the order.

If an order qualifies for free shipping, this will be explicitly stated on the webshop.

We deliver to your home from Tuesday to Sunday in Mechelen and the following surrounding municipalities:

Delivery and Shipping

We work with both our own delivery services and external transport partners to deliver your order safely and efficiently.

While we take the utmost care to ensure correct delivery, we cannot be held liable for delays caused by external carriers, force majeure, weather conditions, strikes or other unforeseen circumstances beyond our control.

Correct address details

The customer is responsible for correctly entering all shipping and contact details when placing an order.

If incorrect or incomplete data is provided, this may lead to delays, failed deliveries or additional shipping costs. Any additional costs arising from this may be passed on to the customer.

Delivery and execution

1. The entrepreneur will always act carefully when processing and executing orders.

2. The place of delivery is the address provided by the consumer when placing the order.

3. The delivery costs are clearly stated on the webshop and are borne by the buyer, unless otherwise indicated.

4. The delivery period is a maximum of 30 days from the order date, unless expressly agreed otherwise.

5. If a product is temporarily unavailable or cannot be delivered on time, the consumer will be informed of this as soon as possible. In that case, the consumer has the choice to:

- wait for delivery, or

- agree on a new delivery period.

6. If delivery proves to be permanently impossible within the foreseen period, the consumer has the right to withdraw from the purchase in writing. The amount already paid will then be fully refunded.

7. If delivery proves to be definitively impossible, a replacement product may be offered. If the consumer does not agree to this, the paid amount will be fully refunded.

In-store pickup

Online orders can be picked up at our store from the next business day, provided the item is available.

Would you like to pick up an order on the same day? Please contact us by phone in advance so we can confirm availability.

Right of withdrawal and Return Policy

Personalized or perishable products

In accordance with article VI.53 of the Code of Economic Law, the right of withdrawal does not apply to:

perishable goods such as fresh flowers;
products manufactured according to consumer specifications;
personalized floral arrangements or decorations.

Sale items or gift cards cannot be returned.

For other products, the consumer has a statutory cooling-off period of 14 calendar days from receipt of the goods. This means that after receiving your item, you have 14 days to request a return. Returns are at the expense and responsibility of the customer, unless otherwise agreed.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

Please note: returns must be sent to the following address: BLOEMENTHEATER, Hoogstraat 2, 2800 Mechelen, Belgium.

Items sent back to us without first requesting a return will not be accepted.

Damages and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Liability

Bloementheater is not liable for:

-indirect damage;

-temporary unavailability of the website;

-damage caused by incorrect use of products;

-damage caused by force majeure.

Bloementheater's liability remains limited in all cases to the amount of the relevant order.

Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within ten business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Applicable law and competent court

This legal notice and all agreements are exclusively governed by Belgian law.

Disputes fall under the jurisdiction of the courts of the district in which Bloementheater is established, unless mandatory law dictates otherwise.
